Voter Registration Applications Promulgated without Rulemaking

Common Cause Florida, the Lawyers’ Committee for Civil Rights Under Law, Fair Elections Center, LatinoJustice, All Voting Is Local, League of Women Voters of Florida, and Demos are raising questions about the lack of rulemaking for the form DS DE 39 – Voter Registration Application. The new forms were promulgated in July as printed and fillable forms and on the online voter registration system – registertovoteflorida.gov in English and Spanish.

Engaging the public in the rulemaking process is important. Why is the state not following this process?

Promulgation of important election materials without following rules makes for bad outcomes – confusion by public and service provider reprogramming/mistakes.

Providing access to voting documents in other languages means taking the time to review them with the public through rulemaking. Why avoid this engagement?
